Santa Clara County Superior Court Announces
Extension of Facsimile Filings

Effective Monday, June 2, 2003, the Superior Court of Santa Clara County is extending the facsimile filings of documents to include civil limited cases, family cases, and Department of Child Support Services (DCSS) cases, except for those documents specified in California Rules of Court, Rule 2002.

Fax filings will be accepted at the following four locations: Downtown Superior Court, 191 North First Street, San Jose (civil limited and unlimited jurisdiction and probate cases); Family Court, 170 Park Center Plaza, San Jose (family cases), Notre Dame Facility, 99 Notre Dame Ave, San Jose (DCSS cases); and South County Facility, 12425 Monterey Road, San Martin (limited civil cases).

The Court’s Automated Fax Filing service must be activated by calling 1-800-487-4567. The filing attorney must provide a credit card number, expiration date, and fax number. The Court will maintain the confidentiality of the filing attorney’s credit card number.

Faxed documents must comply with all filing requirements otherwise listed in the State and Local Rules of Court. Compliance with filing requirements and proper transmission of the documents are the responsibility of the sending party and the automated fax filing service. Fax-filed documents are subject to the following charges and processing rules:

  • The fax filing system operates 24 hours a day, 7 days a week. Documents received after 5:00 p.m., on weekends, or on court holidays will be deemed received and filed the next business day.
     

  • All facsimile-filed documents must be accompanied by the Judicial Council Cover Sheet, form CI-2011.
     

  • The system charges $9.95 per filing processing fee plus a fax usage fee of $1 per page, including the cover sheet, along with any filing fees normally associated with the document. In addition, the Court will add $5 postage and handling fee when a Complaint is filed to cover the cost of returning the Notice to Litigants and Summons by mail.
