Santa Clara County Superior Court Announces
Filing Fees for Motions and Various Hearings
in Civil and Family Cases GC 26830(a)

Effective Monday, June 2, 2003, any notice of motion or any other paper requiring a hearing subsequent to the first paper (except for papers specifically set forth in GC 26830), must be accompanied by the appropriate fee, as follows:

Motion/Order to Show Cause and Ex Parte Motion/Order to Show Cause
The fee to file a motion or an ex parte motion, except for a motion for summary judgment or motion for summary adjudication, is $25.30.

Stipulation and Proposed Order
The fee to file a stipulation and order, except for a stipulated judgment or structured settlement agreement, is $25.30 in addition to any “first paper” fees due on behalf of any defendant, respondent, or intervener, who has signed the stipulation and has not already paid such fees.

Guardian ad Litem
The fee to file a petition for appointment of a guardian ad litem is $25.30 per petition submitted.

Application and/or Proposed Order
The fee to file an application and/or order is $25.30 in addition to any “first paper” fees on behalf of any defendant, respondent, or intervener, who has signed the stipulation and has not already paid such fees.

Order after Hearing
There is no fee for an order after hearing.
