Civil Online Discovery Tentative Rulings

3rd floor of DTS (Downtown
Superior Courthouse) at 191 First Street in San Jose.
Discovery matters are heard every Friday at 8:30 AM and at 10:00
AM.
Tentative Rulings issued by the Civil Discovery Judge will be
accessible in two ways. First, you may visit this
Court web page after 2:00 on the day before the hearing.

Second, Tentative Rulings are also available every Thursday
starting at 2:00 PM by telephoning a tape-recorded message. To reach
this service, visit the telephonic
rulings website or call (408) 882-2100 and follow the menu
instructions.
Tentative Rulings will become Orders of the Court unless
contested according to the following instructions pursuant to
Rule 3.1312 of the California Rules of Court.
Contesting a Ruling
To arrange an appearance to contest a Tentative Ruling, notify
the court at (408) 882-2170 and opposing counsel before 4:00 p.m. on
the court day before the hearing. You may make your notification to
the Court by leaving a message when prompted to do so at the end of
the recorded greeting. When you leave your message, state:
- the case number
- the case name
- the name of the attorney, including phone number and area
code, and
- the issues to be contested
Parties may arrange a telephonic appearance by calling Court Call
Services, an independent vendor, at (310) 342-0888 or 1-888-88COURT.

Parties must also notify the court and opposing counsel of the
intended telephonic appearance.
Parties who do not contest before 4:00 pm on the court day before
the hearing or appear without notice to the court and opposing
counsel will not be heard. If no party has requested oral
argument, appearances are not required and the Tentative Ruling will
be adopted as the ruling of the court.
